GENERAL TERMS AND CONDITIONS OF BUSINESS SPARTANAT SHOP

1 Information requirements
(1) In accordance with Section 5a (1) of the Consumer Protection Act ("KSchG") and Section 4 (1) of the Distance and Off-Premises Sales Act ("FAGG"), Development Group Media (Hatzenbichler & Klemenz GmbH) provides the customer with the following information, insofar as this is already possible within the scope of these General Terms and Conditions ("GTC").
(2) Essential characteristics of the goods: correspond to the respective order.
(3) The operator of the shop and contractual partner of the customer is Development Group Media (Hatzenbichler & Klemenz GmbH), hereinafter referred to as Development Group Media, Dr. Herrmanngasse 4, 9020 Klagenfurt, Tel.: +43 463 339253-0, E-mail: shop@spartanat.com
(4) Total price/total costs: The prices quoted include all taxes and duties. Shipping costs and all expenses incurred in connection with shipping are added to this.
(5) Costs of remote communication: Customer's standard rate.
(6) Terms of payment: Credit card (VISA, MasterCard), PayPal.
(7) Delivery terms: Delivery (post, DHL, or other shipping partner) by the sales or shipping partner.
(8) Right of withdrawal and cancellation: See § 4.
(9) Warranty rights: See § 5.

2 Scope
(1) These General Terms and Conditions, in the version valid at the time of the order, apply exclusively to all legal relationships arising via the online shop under the name "SPARTANAT Shop" (shop.spartanat.com).
(2) By placing an order, the customer accepts these General Terms and Conditions.
(3) Should individual provisions be invalid due to legal requirements, the remaining provisions shall remain valid.

3 Conclusion of the contract
(1) The presentation of the goods in the shop does not constitute a binding offer by Development Group Media. The customer is merely invited to submit an offer.
(2) By clicking on "Order now with obligation to pay," the customer submits a binding offer.
(3) Development Group Media confirms receipt of the order by email. This confirmation does not constitute acceptance of the contract. Acceptance is made by express declaration or by dispatch of the goods.
(4) If the offer is rejected, any payments already made will be refunded within 14 days.

4 Terms of payment, prices & due date
(1) All prices are gross prices in euros including statutory VAT, excluding shipping costs.
(2) The prices shown in the shop apply.
(3) Payment options: PayPal, credit card (Visa & MasterCard).
(4) The purchase price is due immediately.
(5) The contract language is German.

5 Right of withdrawal or cancellation
(1) Consumers have the right to withdraw from the contract within fourteen days without giving reasons.
(2) The withdrawal period begins upon receipt of the goods in the case of goods deliveries; in the case of digital offers, it begins upon receipt of the activation information.
(3) There is no right of withdrawal for:
(a) Magazines outside of a subscription
(b) Digital publications, if delivery has begun before the end of the period and the customer has expressly agreed to this
(c) Goods that have been manufactured according to customer specifications

(5) In the event of withdrawal, Development Group Media will refund all payments, including standard shipping costs, within fourteen days of receipt of the withdrawal.
(6) The refund may be withheld until the goods have been received or the customer provides proof of return.
(7) The goods must be returned within fourteen days of revocation.
(8) The customer shall bear the costs of the return shipment.
(9) The customer shall be liable for any loss in value resulting from unnecessary handling of the goods.

6 Warranty
(1) The statutory provisions apply; there are no further guarantees beyond the manufacturer's warranties.
(2) Complaints must be addressed to the contact details specified in §1.
(3) Development Group Media will take back defective goods whose defect already existed at the time of delivery against refund of the purchase price.

7 Delivery conditions & delivery costs
(1) Delivery exclusively to European addresses.
(2) Delivery time is usually 14 working days, at the latest 30 days from acceptance of the contract.
(3) Shipping costs vary depending on the product.
(4) Delivery is made to the address provided; any changes must be notified immediately.
(5) In the case of SEPA direct debit, the customer authorizes Development Group Media to collect agreed payments.

8 Discount codes
Discount codes are free of charge, limited in time, and tied to promotions. Development Group Media accepts no liability for technical unavailability. Cash redemption is excluded.

9 Data protection
(1) Development Group Media complies with data protection regulations (GDPR, DSG, TKG).
(2) The data provided by the customer will be processed for the purpose of contract execution.
(3) Data will only be passed on to necessary shipping and contractual partners.
(4) The privacy policy can be viewed in the shop.

10 Retention of title
Development Group Media retains ownership of delivered goods until full payment has been received.

11 Final provisions
The place of jurisdiction is Klagenfurt, as far as legally permissible. Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Ineffective provisions shall be replaced by provisions that come closest to the economic purpose. Changes must be made in writing; emails are considered to be in writing.
