privacy policy

The person responsible for data processing is:
Jürgen Hatzenbichler
Dr. Herrmann Gasse 4
A-9020 Klagenfurt
shop@spartanat.com

We appreciate your interest in our online shop. Protecting your privacy is very important to us. Below, we provide detailed information about how we handle your data.

1. Access data and hosting

You can visit our website without providing any personal information. Each time you access a website, the web server automatically saves a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of access, the amount of data transferred, and the requesting provider (access data), and documents the access.

This access data is evaluated exclusively for the purpose of ensuring the smooth operation of the site and improving our offering. Pursuant to Art. 6 (1) (f) GDPR, this serves to safeguard our legitimate interests in the correct presentation of our offering, which prevail within the context of a balancing of interests. All access data will be deleted no later than seven days after your visit to the site.

Hosting services provided by a third party
As part of processing on our behalf, a third-party provider provides us with the services for hosting and displaying the website. This serves to protect our legitimate interests in the accurate presentation of our services, which prevail in the context of a balancing of interests. All data collected as part of the use of this website or in forms provided for this purpose in the online shop as described below is processed on its servers. Processing on other servers only takes place within the framework explained here.

This service provider is located within a country of the European Union or the European Economic Area.

2. Data collection and use for contract processing, contact

We collect personal data when you voluntarily provide it to us as part of your order or when you contact us (e.g. via contact form or email). Mandatory fields are marked as such because in these cases we absolutely need the data to process the contract or to process your contact and without this information you cannot send the order or contact. Which data is collected can be seen from the respective input forms. We use the data you provide in accordance with Art. 6 (1) (b) GDPR to process the contract and process your inquiries. If you have given your consent to this in accordance with Art. 6 (1) (a) GDPR by deciding to open a customer account, we will use your data for the purpose of opening a customer account. After the contract has been fully processed or your customer account has been deleted, your data will be restricted for further processing and deleted after the expiration of the retention periods required by tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use your data in a manner permitted by law, about which we will inform you in this statement. You can delete your customer account at any time and can do so either by sending a message to the contact option described below or via a dedicated function in your customer account.

3. Data transfer

In order to fulfill the contract in accordance with Art. 6 (1) (b) GDPR, we will pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of ordered goods. Depending on which payment service provider you select during the ordering process, we will pass on the payment data collected for this purpose to the credit institution commissioned with the payment and, if applicable, to the payment service provider commissioned by us or to the selected payment service. In some cases, the selected payment service providers also collect this data themselves if you create an account with them. In this case, you must log in to the payment service provider with your access data during the ordering process. The data protection declaration of the respective payment service provider applies in this respect.

We also use an external merchandise management system for order and contract processing. The data transfer and processing that takes place in this regard is based on order processing.

The same applies to the transfer of data to our manufacturers or wholesalers in cases where they carry out shipping for us (drop shipping).

We use payment service providers and shipping service providers based in a country outside the European Union. Personal data is only transferred to these companies if necessary to fulfill the contract.

Data transfer to shipping service providers

If you have given us your express consent to do so during or after your order, we will pass on your email address and telephone number to the selected shipping service provider in accordance with Art. 6 (1) (a) GDPR so that they can contact you before delivery for the purpose of notifying you of the delivery or coordinating the delivery.

You can revoke your consent at any time by sending a message to the contact option described below or directly to the shipping service provider at the contact address listed below. After revocation, we will delete the data you provided for this purpose unless you have expressly consented to further use of your data or we reserve the right to use your data in any other way that is permitted by law and about which we will inform you in this declaration.

Data transfer for age verification

If your order includes goods whose sale is subject to age restrictions, we ensure that the purchaser has reached the required minimum age by using a reliable procedure that includes a personal identity and age verification. For this purpose, we use the SCHUFA Identity Check on our website. This service is operated by SCHUFA Holding AG, Kormoranweg 5, 65201 Wiesbaden.
To ensure the required minimum age, certain personal data (e.g., name, address, and date of birth) are transmitted to SCHUFA Holding AG. A so-called identity check using Q-Bit is then performed, which has been positively assessed by the Commission for the Protection of Minors in the Media (KJM) for age verification.
According to Art. 6 (1) (f) GDPR, the data transfer serves to safeguard our legitimate interests, which prevail within the framework of a balancing of interests, in ensuring an offer that complies with youth protection law and to comply with the statutory provisions on youth protection.
A credit check will not be carried out in this respect.

After the contract has been fully processed and after the retention periods under tax and commercial law have expired, your data processed for this purpose will be deleted unless you have expressly consented to further use of your data or we reserve the right to use the data in any other way that is permitted by law and about which we will inform you in this declaration.

Data transfer to debt collection companies

To fulfill the contract in accordance with Art. 6 (1) (b) GDPR, we will pass on your data to a commissioned debt collection agency if our payment claim has not been settled despite a prior reminder. In this case, the claim will be collected directly by the debt collection agency. Furthermore, the transfer serves to protect our legitimate interests, which prevail within the framework of a balancing of interests, in the effective assertion and enforcement of our payment claim in accordance with Art. 6 (1) (f) GDPR.

4. Email newsletters and direct mail advertising

Email advertising with newsletter registration
If you subscribe to our newsletter, we will use the data required for this purpose or separately provided by you to regularly send you our e-mail newsletter based on your consent in accordance with Art. 6 (1) (a) GDPR.

You can unsubscribe from the newsletter at any time. You can do so either by sending a message to the contact option described below or via a link provided for this purpose in the newsletter. After unsubscribing, we will delete your email address unless you have expressly consented to further use of your data or we reserve the right to use the data in any other way that is permitted by law and about which we will inform you in this statement.

E-mail advertising without registration for the newsletter and your right of objection

If we receive your email address in connection with the sale of a product or service and you have not objected, we reserve the right, pursuant to Section 7 (3) of the German Unfair Competition Act (UWG), to regularly send you offers for products from our range similar to those you have already purchased. This serves to safeguard our legitimate interests in advertising to our customers, which prevail in the context of a balancing of interests.
You can object to this use of your e-mail address at any time by sending a message to the contact option described below or via a link provided for this purpose in the advertising e-mail, without incurring any costs other than the transmission costs according to the basic rates.

The newsletter will be sent as part of processing on our behalf by a service provider to whom we will pass on your email address for this purpose.

This service provider is located within a country of the European Union or the European Economic Area.

Postal advertising and your right of objection

Furthermore, we reserve the right to use your first and last name as well as your postal address for our own advertising purposes, e.g., to send you interesting offers and information about our products by post. This serves to protect our legitimate interests in addressing our customers with advertising, which prevail within the framework of a balancing of interests, in accordance with Art. 6 (1) (f) GDPR.

The advertising mailings are carried out on our behalf by a service provider to whom we pass on your data for this purpose.
You can object to the storage and use of your data for these purposes at any time by sending a message to the contact option described below.

5. Use of data for payment processing

Identity and credit check when selecting Klarna payment services
If you choose Klarna's payment services, we ask for your consent in accordance with Art. 6 (1) (a) GDPR to transmit the data necessary for processing the payment and for identity and credit checks to Klarna. In Germany, the credit agencies listed in Klarna's privacy policy may be used for identity and credit checks.
Klarna uses the information received on the statistical probability of a payment default to make a balanced decision on the establishment, implementation or termination of the contractual relationship.
You can revoke your consent at any time by sending a message to the contact details below. This may result in us no longer being able to offer you certain payment options. You can also revoke your consent to this use of your personal data at any time by contacting Klarna.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The anonymized IP address transmitted by your browser as part of Google Analytics is generally not merged with other Google data. Once the purpose no longer applies and we no longer use Google Analytics, the data collected in this context will be deleted.

7. Social Media Plug-Ins

Use of social plugins from Whatsapp using the Shariff solution.

Our website uses social buttons from social networks. This serves to protect our legitimate interests in the optimal marketing of our offering, which prevail within the context of a balancing of interests, in accordance with Art. 6 (1) (f) GDPR. To increase the protection of your data when visiting our website, these buttons are not integrated into the page as plug-ins without restrictions, but rather simply using an HTML link. This integration ensures that when you access a page on our website containing such buttons, no connection is established with the servers of the provider of the respective social network.

If you click on one of the buttons, a new window will open in your browser and call up the page of the respective service provider, where you can (if necessary after entering your login data) click the Like or Share button, for example.

The purpose and scope of data collection and the further processing and use of the data by the providers on their websites as well as a contact option and your related rights and setting options for protecting your privacy can be found in the providers' data protection information.

Use of social plugins from Facebook, Google, Twitter, Pinterest
Our website uses so-called social plugins (“plugins”) from social networks.
When you visit a page on our website that contains such a plugin, your browser establishes a direct connection to the servers of Facebook, Google, Twitter or Instagram. The content of the plugin is sent directly to your browser by the respective provider and integrated into the page. By integrating the plugin, the providers receive the information that your browser has accessed the corresponding page on our website, even if you do not have a profile or are not currently logged in. This information (including your IP address) is transmitted from your browser directly to a server of the respective provider (possibly in the USA) and stored there. If you are logged in to one of the services, the providers can directly associate your visit to our website with your profile on the respective social network. If you interact with the plug-ins, for example by clicking the "Like" or "Share" button, the corresponding information is also sent directly to a server of the provider and stored there. The information is also published on the social network and displayed to your contacts there. This serves to safeguard our legitimate interests, which prevail within the framework of a balancing of interests, in the optimal marketing of our offer in accordance with Art. 6 (1) (f) GDPR.
The purpose and scope of data collection and the further processing and use of the data by the providers as well as a contact option and your related rights and setting options for protecting your privacy can be found in the providers' data protection information.

You can also completely prevent the plugins from loading using add-ons for your browser, such as the script blocker "NoScript" (https://noscript.net/).

Our online presence on Facebook, Google, Twitter, Pinterest
Our presence on social networks and platforms serves to improve and actively communicate with our customers and prospects. We provide information about our products and current special offers there.
When you visit our online presence on social media, your data may be automatically collected and stored for market research and advertising purposes. From this data, so-called user profiles are created using pseudonyms. These profiles can be used, for example, to place advertisements within and outside the platforms that presumably correspond to your interests. For this purpose, cookies are generally used on your device. Visitor behavior and user interests are stored in these cookies. According to Art. 6 (1) (f) GDPR, this serves to safeguard our legitimate interests, which prevail within the framework of a balancing of interests, in an optimized presentation of our offer and effective communication with customers and interested parties. If you are asked by the respective social media platform operators for consent (approval) to data processing, e.g. using a checkbox, the legal basis for data processing is Art. 6 (1) (a) GDPR.
If the aforementioned social media platforms are headquartered in the USA, the following applies: For the USA, the European Commission has issued an adequacy decision based on the EU-US Privacy Shield. A current certificate for the respective company can be viewed here .
